California Liberty March Initiative

INTRODUCTION​​



In this troubling time of economic uncertainty, as well as rampant political corruption, ineptitude, and governmental lawlessness, the American Constitution is being openly subverted and ignored by elected and appointed officials who swore an oath to protect and defend it.


As a result, every aspect of the American Way of Life is being criminalized, and Citizens are faced with the loss of their unalienable rights as enumerated in the Constitution.



An onerous decision must be made: To accept the status quo, and allow the Constitution to be rendered meaningless; thus, enabling government to continue to grow unabated until it literally enslaves us; or, to force politicians to act in strict accordance with the Constitution and to enact policies essential to the preservation of our individual rights and liberties.

GRIEVANCES​

Whereas, government in America exists solely to serve the Public Good, and should be limited in its powers and activities as specified in the Constitution, and should never enable Society to strip the Individual of his or her unalienable rights,

Whereas, equal application of and protection under the law for all Americans is the foundation for a free and lawful society, 


Whereas, state and federal government have already taken and threaten to continue to take away unalienable rights and powers from the individual in the name of public safety and national security,


Whereas, the rights of the Individual have been diminished and abrogated by the Political Class so that elected and appointed officials can enrich and empower themselves at the expense of those they are supposed to represent,

Whereas, the Political Class at both the State- and Federal-levels - in order to dramatically increase the size and scope of government - have proposed and legislated policies and regulations that burden us with unsustainable state and national debt and unnecessary, excessive taxation,


Whereas, the use of proxies and agents in academia, media, military and corporations to propagandize on behalf of Administrations and hostile ideological Agenda that seek to subvert the Federal Constitution, is a breach of the public trust, and an act of war against the Federal Constitution (and by extension, the United States of America), and is detrimental to the continuance of this nation as a free republic,


Whereas, the Political Class has, through the use of demagoguery or the misappropriation of taxpayer monies, enriched and empowered certain special interest groups over other Americans as payback for political contributions and support,



Whereas, the will of the majority of citizens who opposed the passage of the Patient Protection and Affordable Care Act (PPACA), also known as ObamaCare, was blatantly ignored by a partisan Congress and Administration, resulting in unacceptable taxation and the elimination of Americans' liberties and freedom of health care choice,

Whereas, it is apparent that the public has now become servant to the public servant, and that the Political Class views citizens as subjects to their political will, therefore,


We the Signers of this petition, being Free Citizens and Individuals empowered by God to pursue our life, liberty, and happiness without extra-constitutional infringement by Government, demand that fundamental policy changes occur at all levels of governance in California.


We the Signers demand that the remedies listed below must be put into place in order to restore the rule of law in this state, and to ensure that the Political Class in California never again abuse its position and powers to betray the State and Federal Constitutions.

DEMANDS​

The following demands and provisions constitute a suggested bill called, the Governmental Transparency and Constitutional Accountability Act, also known as, The California Liberty March Initiative.

Agenda-Free Primary and Secondary Curricula and Education - Any socio-political material incorporated into primary and secondary educational curricula that is age-inappropriate and of a graphic sexual nature, or which promotes political values and ideology that seek to undermine, replace, or eliminate the American Constitution, must be immediately defunded and eliminated.

Balanced Budget Deadline Penalty - If a balanced California Budget is not submitted to the Governor for signing by the legal deadline, none of the state legislators will receive salaries until they do so. If, after 30 days of the mandated deadline, they have failed to submit a reasonable balanced budget, every member of the California State Legislature forfeits their state-provided pensions and benefits. Base-lines will no longer be used as the starting point for developing the State Budget.  



Citizens and Veterans First Educational Priority - California State residents must receive priority college and university placement, and financial aid assistance for education, before any state or federal money for education is allocated and spent on non-citizens and illegal aliens. Honorably-discharged Veterans who reside in California, regardless of duration, qualify for in-state tuition fee status at any publicly-funded college and university or training school in the state.  


Constitutional Adherence – All rights, as enumerated in the Constitution, shall no longer be infringed or violated by officials and agents of the State of California or by any municipal and unincorporated officials and agents under the state’s jurisdiction. The right to keep and bear arms in California, henceforth, shall not be infringed. No law will be proposed, drafted, or signed into law that is evidently unconstitutional, or which intentionally or unintentionally infringes upon or deprives citizens of their enumerated rights. Any legislator, who, through word or deed, knowingly undermines, subverts, or otherwise runs counter to the Constitution will be immediately removed from office for violating their oath of office.

 

​​​​​​​​​Equal Application Of and Protection Under the Law​​​​ - All state legislators, senators, and congressional representatives must live by and according to any and all laws they pass that every other citizen is forced to live by. No special considerations will be allowed to continue that exempt our elected and appointed officials from living in accordance to laws set forth for every other citizen. In addition, no law will be continued or passed that financially or politically favors any one class or group of Americans over another, or which affords special interests protected status.​​

Legislative Accountability - Every California State bill that is drafted must list the name and affiliations of every individual who takes part in its drafting, amending, and subsequent signing. This information must be easily accessible by the public no more than one day after each individual participant's involvement, every step along the process.

Lobbying Transparency - All California State lobbyists must register with the state district attorney and this information must be easily accessible by the public for posterity. The name of every individual who is lobbying on behalf of a special interest group or corporation must also be recorded, along with a clear notation as to the purpose of their visits.

Protection from Unreasonable Searches and Seizures by Government Agencies - Agents of the TSA must provide a traveler with a court-issued warrant in order to search specific parts of that specific traveler's person. Should the TSA fail to provide such a warrant, its agents cannot compel travelers to submit to physical pat-downs and strip searches. Additionally, without a specific court-issued warrant, the TSA cannot prevent travelers from boarding any form of transportation that the traveler has the means and right to utilize should that traveler refuse to comply with physical searches. The DHS has no right or power to capture, store, or read the e-mails of private citizens, regardless of how the messages are relayed, without a court-issued warrant to do so, and then, only if the warrant specifies specific persons who have been deemed as threats to national security by a judicial body, as per constitutional definitions. 



Repeal Obamacare - Implement policy that allows Free Market solutions to Healthcare Insurance to occur in this state.



Term Limits – California State-level Officials will serve no longer than three terms in any office. Congressional Terms limits for Representatives and Senators are needed, as well, and should be pursued through Constitutional Amendment.

Transparency and Honest Representation - No bill will be voted on behind closed doors, after normal business hours, or without signed affirmation from legislators that they have completely read and understood what they are signing. The Public must have at minimum two weeks to be able to review bills online prior to any votes taken by Legislators.

Truth in Advocacy - Any legislator who is found to be intentionally misrepresenting the purposes, costs, implementation, and probable ramifications of a bill to the public will be immediately removed from office and investigated by the State District Attorney for conspiracy to defraud the public.

Veterans' Mental Healthcare Initiative - Any and all U.S. Veterans and their spouses and dependents who have permanent residence in the state of California will be guaranteed timely, government-funded treatment for mental health issues related to their service. In addition, no benefits for, or services to, illegal aliens will be provided by the state until American Veterans with immediate and pending mental health care needs are first taken care of.   

Voting Record Accountability - Every single vote taken by legislators must be officially recorded and easily accessible for review by the public no later than one day after the vote was taken. Legislators who fail to vote in one-third or more of all votes taken will not be paid salaries for the remainder of their term, until their voting record improves. Should they miss more than fifty percent of all voting during their term(s) in office, they forfeit their state-provided pensions and benefits.


 

We, the undersigned, demand that the California Governmental Transparency and Constitutional Accountability Act be enacted as law in California by April 15, 2014.
